Private-Schools.co.ke provides:

  • A directory platform for schools in Kenya
  • Subscription packages for school listing enhancement (Basic, Featured, and Premium)
  • Advertising opportunities for businesses and organizations
  • Lead generation services connecting parents with schools
  • Search and discovery tools for parents seeking educational institutions

3. Account Registration

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription Packages

4.1 Package Types

We offer the following subscription packages:

  • Basic Package: Free forever with basic listing features
  • Featured Package: KES 5,000 per month with enhanced visibility and up to 20 leads/month
  • Premium Package: KES 10,000 per month with top placement and unlimited leads

4.2 Billing and Payment

  • Subscription fees are billed monthly in advance
  • Payment is completed via M-Pesa Paybill (NCBA) using your invoice number as the account number
  • Payments are verified manually before subscription activation
  • All prices are in Kenyan Shillings (KES) and are subject to change with 30 days' notice
  • You are responsible for all applicable taxes related to your subscription

4.3 Auto-Renewal

  • If you enable auto-renewal, your subscription will automatically renew each month
  • Your payment method will be charged automatically on the renewal date
  • You can disable auto-renewal at any time from your account dashboard
  • Disabling auto-renewal will not affect your current subscription period

5. Cancellation Policy

5.1 How to Cancel

You may cancel your subscription at any time by:

  • Logging into your account and clicking "Cancel Subscription" on your subscription management page
  • Contacting our support team via email or contact form
  • Sending a written notice to our registered business address

5.2 Effect of Cancellation

  • Immediate Access: Upon cancellation, you will retain access to your paid features until the end of your current billing period
  • No Pro-rata Refund: Cancellations do not entitle you to a refund for the remaining portion of your billing period
  • Downgrade to Basic: After your paid period expires, your listing will automatically revert to the free Basic package
  • Data Retention: Your school information and account data will be preserved
  • No Long-term Contracts: All subscriptions are month-to-month with no long-term commitment required

5.3 Cancellation Notice Period

No advance notice is required for cancellation. However, to avoid being charged for the next billing cycle, you must cancel before your renewal date.

6. Refund Policy

6.1 General Refund Terms

All subscription payments are non-refundable except as expressly stated in this policy or required by applicable law.

6.2 Eligible Refund Scenarios

Refunds may be issued only in the following circumstances:

  • Duplicate Payment: If you are accidentally charged twice for the same subscription period, the duplicate charge will be refunded in full
  • Payment Processing Error: If a technical error results in incorrect charges, we will refund the difference
  • Service Non-Delivery: If we fail to provide the subscribed service due to technical issues on our end, and the issue is not resolved within 7 business days, you may request a pro-rated refund
  • Unauthorized Charges: If your account was charged without authorization due to security breach on our end, charges will be refunded in full

6.3 Non-Refundable Situations

Refunds will NOT be issued for:

  • Change of mind or cancellation mid-billing cycle
  • Lack of usage or engagement with the service
  • Dissatisfaction with lead quality or quantity (leads are opportunities, not guaranteed enrollments)
  • Failure to cancel before the renewal date
  • Account suspension or termination due to Terms violation
  • Technical issues on your end (internet connectivity, browser compatibility, etc.)

6.4 Refund Request Process

  • Submit Request: Contact our support team with your order/transaction reference number
  • Review Period: Refund requests are reviewed within 5-7 business days
  • Processing Time: Approved refunds are processed within 7-14 business days
  • Refund Method: Refunds are issued to the original payment method used for the transaction
  • M-Pesa Refunds: For M-Pesa payments, refunds may take 3-5 business days to reflect in your account

6.5 Upgrade/Downgrade Policy

  • Upgrades: When upgrading to a higher package, you pay the pro-rated difference for the remaining days in your current billing cycle
  • Downgrades: When downgrading, the change takes effect at the end of your current billing period. No refund is issued for the difference

7. School Listings and Content

7.1 Listing Accuracy

Schools are responsible for ensuring all information provided is accurate, current, and truthful. This includes:

  • School name, location, and contact information
  • Fee structures and pricing
  • Curriculum and academic programs
  • Facilities and amenities
  • Licensing and accreditation status

7.2 Content Guidelines

You agree not to submit content that:

  • Is false, misleading, or deceptive
  • Violates any laws or regulations
  • Infringes intellectual property rights
  • Contains offensive, defamatory, or inappropriate material
  • Promotes discrimination or hate speech
  • Contains spam, malware, or malicious code

7.3 Content Ownership and License

  • You retain ownership of all content you submit
  • By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on our platform
  • We reserve the right to remove or modify content that violates these Terms

8. Lead Generation Services

8.1 Lead Delivery

  • Parent leads are genuine inquiries from users of our platform
  • Lead limits apply based on your subscription package (Featured: 20/month, Premium: unlimited)
  • Leads are delivered via email notification in real-time
  • We do not guarantee lead quality, conversion rates, or enrollment outcomes

8.2 Lead Usage

  • Leads are provided exclusively for your school's enrollment purposes
  • You may not share, sell, or transfer leads to third parties
  • You must comply with data protection laws when handling lead information
  • You should respond to leads professionally and promptly

9. Advertising Services

For banner advertising and sponsored content:

  • Advertising contracts are subject to separate agreements
  • Ad placement and duration are specified in individual contracts
  • We reserve the right to reject advertising that violates our content guidelines
  • Refunds for advertising services are governed by individual contract terms

10. Service Modifications and Availability

10.1 Changes to Services

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of our services at any time
  • Change package features, pricing, or terms with 30 days' notice
  • Update our website, platform, and user interface

10.2 Service Availability

  • We strive for 99% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance when possible
  • We are not liable for service interruptions due to factors beyond our control

11. Prohibited Activities

You agree not to:

  • Use the service for any illegal purpose
  • Impersonate another person or entity
  • Scrape, crawl, or data mine our platform
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service or servers
  • Use automated systems or bots without permission

12. Account Suspension and Termination

  • Receive multiple complaints from users

12.2 Effect of Termination

  • Terminated accounts forfeit all paid subscription benefits immediately
  • No refunds are provided for accounts terminated due to Terms violations
  • Your school listing will be removed from the platform
  • You may be prohibited from creating new accounts

13. Intellectual Property

  • All website content, design, logos, and trademarks are owned by Private-Schools.co.ke or our licensors
  • You may not use our intellectual property without written permission
  • Respect the intellectual property rights of other users and third parties

14. Third-Party Services

Our platform integrates with third-party services including:

  • Google AdSense: For advertising (subject to Google's terms)
  • Google Analytics: For website analytics

We are not responsible for third-party services' actions, policies, or availability.

15. Limitation of Liability

To the fullest extent permitted by law:

  • Our services are provided "as is" without warranties of any kind
  • We do not guarantee specific enrollment outcomes or lead conversions
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for services in the 12 months preceding the claim
  • We are not responsible for user-generated content or accuracy of school listings
  • We are not liable for third-party actions or service interruptions

16. Indemnification

You agree to indemnify and hold harmless Private-Schools.co.ke, its affiliates, and employees from any claims, damages, or expenses arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Content you submit to the platform

17. Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya.
